1 - General provisions relating to these general terms and conditions of sale

These general terms and conditions of sale, hereinafter referred to as the "GTC", apply to all orders placed on the website at www.motoblouz.com, hereinafter referred to as the "Site", published by the company D3T DISTRIBUTION, hereinafter referred to as "MOTOBLOUZ", a simplified joint-stock company with a capital of €9,195.00, registered with the Arras Trade and Companies Register under number 478 566 250, having its registered office at 72 rue Elie Cartan, artisan zone of the Gare d’Eau 62220 CARVIN, represented by Mr. Jérôme Dalidet.

The GTC are made available to internet users, visitors or Customers, on the Site where they can be consulted directly and can also be communicated to them upon simple request by any means.

By registering on the Site, the Customer confirms that they have read the GTC and accepts them, thereby becoming contractually bound by their terms.

MOTOBLOUZ reserves the right to adapt or modify the GTC at any time. In the event of modification, the GTC in force on the day of the order will apply to each order.

MOTOBLOUZ reserves the right to modify the content of the Site or the services available on it at any time and without notice, and/or to temporarily or permanently cease to operate all or part of the Site.

Compliance with Extended Producer Responsibility (EPR):

In accordance with the anti-waste law for a circular economy (AGEC Law), Motoblouz (D3T Distribution) adheres to various eco-organisms.

Our unique identification numbers (IDU) by sector are:

Article 2 - Our offer

All offers for products, services and delivery methods, at the prices indicated in Euros, are valid in mainland France within the limits of available stock.

For orders from the European Union, the VAT rate applied is the same as that of France. You will simply need to pay additional shipping costs which will be indicated when choosing the delivery method.

For orders from abroad or from the DOM-TOM, products will be invoiced to you excluding taxes and you will have to pay shipping costs calculated according to the destination country and the weight of the package. Upon receipt of the package, you will need to pay customs duties and local VAT according to the destination country. The amount of shipping costs will be indicated when choosing the delivery method.

A description with the essential characteristics of the product is present on each item we sell. However, some minimal variations may occur, which is why it is recommended to contact our customer service at 03.21.43.33.04 in case of doubt.

The photographs illustrating the products and their descriptions do not constitute a contractual document.

Our teams make every effort to provide an accurate image of the products offered for sale through the images or photographs used for their presentation. However, variations may occur, particularly due to technical limitations, color rendering or customer equipment (internet browser, screen used). Motoblouz recommends that the customer refer to the product descriptions on the site to know their essential characteristics.

Except in the case of a warranty (see article 10 below), any transaction between Motoblouz and its customers, not contested within 14 days from the delivery of the goods, cannot give rise to a claim.

Article 3 – Creation of the Customer account

To place an order on the Site, the Customer must first create their personal customer account. To create an account, the User must provide information allowing their identification, including their name, first name, title, email address, postal address, and phone number.

Only one Customer account can be created per email address. Once created, to access it, the Customer must identify themselves using their username and personal and confidential password.

When creating the account, the Customer must choose a password. This must be sufficiently secure.

Each Customer agrees to maintain strict confidentiality regarding the data, particularly the username and password, allowing them to access their customer area. The Customer acknowledges being solely responsible for access to the service via their username and password, except in the case of proven fraud.

Each Customer also agrees to inform MOTOBLOUZ without delay at the following address: contact@motoblouz.com in the event of loss, theft or fraudulent use of their username and/or password.

After creating their personal customer area, the Customer will receive an email confirming the creation of their customer area.

The Customer agrees upon registration to:

  • provide real, accurate, up-to-date information at the time of entry in the registration form and in particular not to use false names or addresses, or names or addresses without authorization;
  • keep the registration data up to date to ensure their real, accurate and up-to-date nature at all times.

The Customer also agrees not to make available or distribute illegal or reprehensible information (such as information constituting identity theft) or harmful information (such as viruses). Otherwise, MOTOBLOUZ reserves the right to suspend the Customer's access to the Site or to delete the account.

The Customer acknowledges that the characteristics and constraints of the Internet do not allow for the guarantee of security, availability and integrity of data transmissions over the Internet.

Thus, MOTOBLOUZ does not guarantee that the Site and its services will operate without interruption or malfunction. In particular, its operation may be temporarily interrupted for maintenance, updates or technical improvements, or to evolve its content and/or presentation.

MOTOBLOUZ cannot be held responsible for the use that would be made of the Site and its services by Customers in violation of these GTC and for any direct or indirect damages that this use could cause to a Customer or a third party.

In particular, MOTOBLOUZ cannot be held responsible for false statements made by a Customer.

Article 4 – Order

The order can only be recorded on the site if you have a customer account. Any order implies unconditional acceptance of these General Terms and Conditions of Sale, which must be consulted and accepted by the Customer before final validation of the order.

Any order constitutes acceptance of the prices and description of the products available for sale.

The offers for products and prices are valid within the limits of available stock.

In the event of unavailability of a product after placing the order, MOTOBLOUZ will inform the Customer as soon as possible. The Customer may then choose to obtain a refund of the corresponding amount or a replacement with an equivalent product when possible.

Upon validation of your order, it will be transmitted to our logistics services for processing. You will receive an automatic acknowledgment of receipt email within the hour.

Motoblouz reserves the right to cancel any order:

  • made by a Customer with an ongoing dispute.
  • exhibiting an abnormal or fraudulent nature.
  • exhibiting a suspicion of fraud related to the payment method.

Article 5 – Prices

Prices are indicated in euros (€) and take into account the applicable French VAT. The prices of products and services are subject to change. The prices charged are those in effect on the day the order is placed. They appear on the product presentation sheets offered for sale and on the Customer's order confirmation.

In the event of a promotion, MOTOBLOUZ commits to apply the promotional price to any order placed during the period covering the promotion.

The price is payable in full upon confirmation of the order, except for the payment facility according to the various installment options without fees detailed in article 6.5 below. The displayed prices include discounts and rebates that MOTOBLOUZ may offer.

If delivery or transport fees apply (see article 7 below), they will be added to the order price and indicated separately before validation by the Customer. The total amount due from the Customer and its details are indicated on the confirmation page of each order.

In the event of a partial return of your order including products eligible for a promo code, the discount amount will automatically adjust according to the conditions of that code.

Example: I ordered a product worth €100 with a discount of -10% and a product worth €300 with a discount of -20%. The total of my order amounts to €400, but I benefit from a discount of €70 distributed as follows: €10 for the product worth €100 (-10%) and €60 for the product worth €300 (-20%). I decide to return the product worth €300. I will therefore receive a refund of €240 which corresponds to the value of the product of €300 minus the discount of €60 related to the promo code.

In the event of a complete return of your order, the amount of the discount related to the promotional code is cancelled.

Article 6 – Payment and security

6.1 BY BANK CARD

Payment is made on our secure payment interface when placing an order on Motoblouz.com, but also on our electronic payment terminal for orders in The Shop Motoblouz. Motoblouz.com certifies that it does not hold any banking information entered during the ordering process. Any banking details are transmitted in real-time to our partner Hipay.

For purchases made online, the debit from your account occurs at the time of preparation of your order, Hipay provides us with a pre-authorization for debit, valid for 6 days. If shipping occurs beyond these 6 days, your account may be queried again. For purchases made in-store, the debit is immediate.

Payment security: Your credit card details are encrypted using the TLS (Transport Layer Security) protocol and are never transmitted in clear over the network. Payment is made directly with the bank. Motoblouz.com does not have access to these details in any case and does not store them on its servers. This is why they are requested again for each new transaction on our site.

The Customer explicitly acknowledges having the rights to use the payment method they have selected.

6.2 VIA PAYPAL

Your payments are made directly on the PayPal site via pages encrypted using the TLS (Transport Layer Security) protocol. Motoblouz.com does not have access to your banking details in any case. The Customer accepts the general terms of use of the PayPal payment method. If the payment is refused or you refuse the transaction, it will be cancelled and you can choose a new payment method on the site.

6.3 VIA APPLE PAY

You just need to authenticate with Face ID, Touch ID or your access code. Apple Pay uses a number unique to your device and a unique transaction code. Motoblouz.com does not have access to your banking details in any case.

IMPORTANT: for payments in 10x, an additional verification system may be requested to ensure the security and acceptance of your financing. You will then need to select your banking institution and enter your login information. This procedure is 100% secure to ensure the protection of your data.

6.4.2 Special conditions for payment in installments

FLOA - 3X WITHOUT FEES
Motoblouz.com offers you its payment facility to pay in 3 installments by bank card from €50 of purchase. This service is available on motoblouz.com. The total amount of the order will be divided into 3 monthly payments. The first monthly payment will be debited upon validation of the order and payment. The following monthly payments will be debited every 30 days from the date of the first debit. Valid in Metropolitan France and overseas. This financing service is provided by our partner FLOA. If you wish to subscribe to this service, your details will then be transmitted to FLOA who, subject to acceptance of your application, will provide you with a payment schedule summarizing the amounts of the various monthly payments.

4X & 10X
For any purchase exceeding the required minimum purchase amounts (see table above) made in France (including Corsica and DOM-TOM), the customer has the option to pay their order in 4 or 10 installments with FLOA. At the time of payment for your order, choose "Pay from 4x to 10x", this financing service is provided by our partner FLOA. If you wish to subscribe to this service, your details will then be transmitted to FLOA who, subject to acceptance of your application, will provide you with a payment schedule summarizing the amounts of the various monthly payments. Upon validation of your order, you will pay the amount of the 1st monthly payment as well as the clearly displayed financing fees (spread over all your monthly payments). You will then be debited for the other monthly payments according to the payment schedule that has been communicated to you.

GENERAL CONDITIONS FLOA (FRANCE)

PAYPAL 4X

Your payments are made directly on the PayPal site via pages encrypted using the TLS (Transport Layer Security) protocol. Motoblouz.com does not have access to your banking details in any case.

You just need to select PayPal at the time of payment. Once connected to the PayPal server, scroll down and select payment in 4 installments. The amount of the 4 installments and the fees are clearly displayed on the screen. As with the standard PayPal payment, the transaction is perfectly secure and Motoblouz.com does not have knowledge of your banking information.

6.5 DEFERRED PAYMENTS WITH FLOA (BUY NOW, PAY LATER!

6.5.2 Special conditions for deferred payment

FRANCE

For any purchase exceeding the required minimum purchase amount (see table above) made in France (including Corsica and overseas territories), the customer has the option to pay for their order 15 days or 30 days after the purchase with FLOA. At the time of payment for your order, choose deferred payment (in 15 days, 30 days), this financing service is provided by our partner FLOA. If you wish to subscribe to this service, your details will then be forwarded to FLOA who, subject to acceptance of your application, will provide you with a payment schedule summarising the amount of the various instalments.

Upon validation of your order, you will pay the amount as well as the financing fees clearly displayed 15 or 30 days later.

Please note that systematic authorisation cards such as Electron or Maestro, Revolut and Nickel accounts, e-cards, virtual cards, Indigo cards and American Express are not accepted for the Deferred Payment of 15 days or 30 days.

GERMANY


For your purchases on our site, we offer you the option to pay for your order using the financing solutions of our partner Alma. Access to this payment system is conditioned by the full acceptance by the Buyer of the contractual conditions applicable to the Financing granted by Alma.

Granting and refusal of financing: Alma reserves the right to accept or refuse your financing request. We draw your attention to the fact that the non-approval of Financing for an order may result in its automatic cancellation. In the event of a financing refusal by Alma, the Buyer cannot be compelled to pay in cash or use another payment method for this order.

Termination: In the event of termination of these general sales conditions between the Buyer and Motoblouz, this will automatically lead to the termination of the Financing granted by Alma.

Customer service and complaints: For any request or complaint regarding the financing services covered by this contract, the Buyer is invited to contact Alma's support directly at the following address: support@getalma.eu.

Personal data: If you choose to pay for your order using this payment solution, your personal data will be forwarded to Alma for the purpose of studying your financing request, managing your credit contract and, if applicable, for recovery.

6.6 BY GIFT CARDS

The gift card guarantees you a successful gift every time. It can be used on the entire Motoblouz.com site and is used at the time of choosing the payment method. It is also usable in our stores in Seclin and Carvin.

The use of the gift card for the payment of your order can be combined with our ongoing promotional codes. The amount of the gift card can be used multiple times. The gift card is valid for one year from the date of purchase.

When returning an item from your order, your gift card will be credited as a voucher in your customer account.

The gift card is non-refundable.


WARNING: the sale of gift cards on the Motoblouz site is not available for customers residing outside Europe (including overseas territories). Payment in 3 instalments without fees is not available for the purchase of gift cards. Vouchers cannot be used for the purchase of gift cards.

6.7 BY BANK CHEQUE

In the case of payment by cheque, your order is reserved for 15 days. Beyond this period, without receipt of your cheque, it will be cancelled. The order will only be processed upon receipt of your cheque and after validation. The announced shipping time may vary depending on the time taken to receive your payment.

Payment by cheque is available on our site up to 1500€. Payment for an order exceeding 1500€ remains possible; for this, please contact your customer service at 03.21.43.33.04

You can also pay for your order in 3 instalments without fees from 150 € of purchase and for the payment of an order with a maximum value of 1500€. Payment for an order exceeding 1500€ remains possible; for this, please contact your customer service at 03.21.43.33.04.


Procedure:
  • Date your cheques with the date of the day of purchase.
  • Write your order number on the back of each cheque.
  • The first cheque will be debited immediately and the others at one-month intervals.

If you wish, note the day of debit that suits you in the month.

6.8 BY BANK TRANSFER

Your order is then reserved for 15 days. Beyond this period, without receipt of your transfer, it will be cancelled. The order will only be processed upon receipt of your transfer, and after validation. The announced shipping time may vary depending on the time taken to receive your payment. Payment by bank transfer is available directly on the site up to 1500€, for payment beyond this amount, please contact your customer service at 03.21.43.33.04. In the case of payment by bank transfer, additional fees charged by the issuing bank cannot be deducted from the payment to be received. Each party must bear the transfer costs that its bank applies to it.

6.9 IN CASH

When placing an order at the Motoblouz Shop in Carvin or in the Seclin store, you have the option to pay for your order in cash up to 1500 euros. This payment method is not available on motoblouz.com.

6.10 PAYMENT BY ILLICADO CARD

It is now possible to pay all or part of your order with an Illicado gift card. You can pay up to 250 euros with an Illicado card (within the limit of 50 euros per transaction for cards intended for individuals).

1. Enter the card number on the back of the card (19 digits) in the designated field.

2. After scratching the grey area on the back of the gift card, enter the visual cryptogram in the designated field (3 digits).

It is possible to make a partial payment with an Illicado gift card and complete the payment of your order with a credit card.

In case of cancellation or return for refund of all or part of the order, your Illicado gift card will be re-credited directly. WARNING: Be sure to keep your Illicado card. If your Illicado gift card is no longer active, a credit will be available in your Motoblouz customer account.

If your return is from an order made in-store, then the refund will be made in the form of a credit.

6.11 PAYMENT BY BANCONTACT

It is now possible to pay all or part of your order with Bancontact.

With Bancontact, it is easy, quick, and secure to pay. When validating the order, select the Bancontact payment method and you will then be redirected to the Bancontact online portal. Thus, Motoblouz.com does not have access to your banking information. Payment is made by scanning the QR code with the Bancontact app on your smartphone, or by using your credit card and a digipass. The Bancontact payment is debited immediately when placing the order.

6.12 PAYMENT BY iDEAL/WERO

It is now possible to pay all or part of your order with iDEAL/WERO.

With iDEAL/WERO, it is easy, quick, and secure to pay. When validating the order, select the iDEAL/WERO payment method and you will then be redirected to the iDEAL/WERO online portal. Thus, Motoblouz.com does not have access to your banking information. Payment can be made by scanning the QR code with the iDEAL app on your smartphone. The iDEAL/WERO payment is debited immediately when placing the order.

6.13 RETENTION OF TITLE CLAUSE

The products remain the property of Motoblouz.com until full payment is received. However, from the time of delivery, the risks of the delivered goods are transferred to the customer.

6.14 DEFAULT OF PAYMENT

Motoblouz.com reserves the right to refuse to deliver or honour an order from a consumer who has not fully or partially paid for a previous order or with whom a payment dispute is being administered.

6.15 ANTI-FRAUD CONTROL

Securing your orders on Motoblouz.com is a major concern. That is why orders are checked before shipping.

As part of this control and in order to combat fraud and the misuse of payment methods on the Internet, Motoblouz may ask the customer to provide proof of identity and residence. Depending on the date of receipt, the shipping time of your order may be delayed. Please note that identity documents are analysed and deleted after validation.

If the control of these documents is favourable, the order will be validated. Otherwise, or in the case of non-receipt, Motoblouz reserves the right to cancel the order. It would then be cancelled and refunded.

6.16 TRUSTPILOT TRUST SEAL

Your purchase on Motoblouz gives you the opportunity to participate in a satisfaction survey organised by Trustpilot. Through a satisfaction questionnaire aimed at measuring the quality of service provided to you throughout your purchase process, you can share your personal experience and share it with the community on Trustpilot and Motoblouz.com. This questionnaire is sent by Trustpilot via email 7 days after the shipment of your order. Trustpilot uses an intelligent customer evaluation service that allows users of merchant sites to have full confidence when transacting online. E-merchants can thus openly show their customers' opinions regarding their services. 7. Delivery Terms and Times

7.1 Shipping Terms

Motoblouz.com commits to respecting the shipping date provided to you as an indication in the product sheet, in the cart, in the summary of your order, and in the order confirmation email. A delivery date will also be indicated when you have chosen the delivery method that suits you best.

When ordering multiple items, the delivery time to consider is the longest one. For example, if you order a jacket shipped within 48 hours and a helmet shipped within 7 days, then the entire order will be shipped within 7 days.

Packages are shipped from Monday to Friday, excluding public holidays.

In the case of a very large order (approximately a pallet of products), delivery may be tailored and the time and cost of this delivery may be adjusted. In this case, a Moto-advisor will contact you.

When you choose your preferred mode of transport, you will notice that the name of the carrier does not appear at this stage. Indeed, in order to ensure you the best quality of service, we have decided to work with several carriers for each type of delivery. In other words, you choose the mode of transport that suits you best, and we decide on the carrier likely to meet this request under the best conditions (based on price, quality of service, your delivery location).

You will be informed of the carrier used when your order is shipped. An email will then be sent to you, indicating in particular the name of the chosen carrier, as well as the tracking number of your package.

Delivery to a relay point / locker (24/7):

Convenience stores, newsagents, dry cleaners, florists, and Lockers…: relay points are local merchants. Lockers are mainly located in high-traffic areas. You can therefore choose to have your order delivered to a relay or locker close to your home or workplace!

Upon deposit of your package at a relay point or locker, you will receive an SMS and/or email to inform you. To collect your package, you must bring an identity document or use the PIN code or QR Code, thus your package will be handed over to you at the relay point. To collect your package from the locker, bring the PIN code received previously by SMS and/or email and follow the instructions on the locker screen.

Note: most of the time, relay points and lockers are not stocked by carriers on Mondays (as many businesses are closed that day). Therefore, the indicated delivery time (24h or 48h) takes into account that the days are working days from Tuesday to Saturday.

We remind you that you have the choice between a delivery time of 24h or 48h, depending on your need. If the package is not collected within 5 calendar days (this period may be subject to change depending on the carrier or the time of year), it will be returned to the sender.

Home delivery in 48h / 72h working days:

Deliveries are made from Monday to Saturday.

You will receive an email from our carrier, usually the day before delivery, to inform you of the expected delivery date. In order to deliver your package, the driver may ask you for the PIN code received by SMS and/or email.

If you are absent during delivery:

  • If the size of your package allows it, it will be deposited in your mailbox.
  • If not, a digital delivery notice will be sent to you by SMS or email inviting you to go to the designated relay point to collect your package.

Home delivery or to your workplace in 24h working days:

Deliveries are made from Monday to Saturday.

On the day your package is picked up by the carrier, you will receive an email and/or SMS to inform you of the expected delivery date. You then have the option, until midnight, to modify the delivery location and/or date on the carrier's site! On the day of delivery, in the early morning, you will receive an SMS indicating the estimated delivery time slot (for example: "your package will be delivered between 10:20 and 11:20"). In order to deliver your package, the driver may ask you for the PIN code received by SMS and/or email.

If delivery could not be made, the package is automatically dropped off at a relay point close to your home. You will find, if access allows, a delivery notice in your mailbox. You will also be notified of a "digital delivery notice" by SMS or email inviting you to go to the designated relay point to collect your package.

Don't forget to bring an identity document!

In case of impediment, you also have the option to authorise a person of your choice to collect your package. They must be equipped with a signed authorisation letter from you and their identity document. If the package is not collected within 5 calendar days (this period may be subject to change depending on the carrier or the time of year), it will be returned to the sender.

If you choose delivery to your workplace, it is imperative to include the company name as well as the name and surname of the recipient in the delivery address. Without these indications, we cannot guarantee delivery to the chosen location.

Click and Collect Delivery

The Click and Collect delivery allows you to order your items on the site and pick them up in our stores:

  1. The Motoblouz store, located at 72 rue Elie Cartan, 62220 Carvin. The store is open from Monday to Saturday, from 10:00 to 19:00.
  2. The Lille-Seclin store, located in Zone Unexpo, Rue de l'Industrie, 59113 Seclin. The Lille-Seclin store is open on Monday from 14:00 to 19:00 and from Tuesday to Saturday, from 10:00 to 19:00.
  3. The Tours - Motors Avenue store, located at 15 Avenue du Danemark, 37100 Tours. The Tours store is open from Tuesday to Friday from 9:00 to 12:30 and from 14:00 to 18:30, and on Saturday from 9:30 to 12:30 and from 14:00 to 18:00.
  4. The Angers-Beaucouzé store, located at 14 rue du Pavillon 49070, Beaucouzé. The store is open from Tuesday to Saturday from 10:00 to 19:00.

You will receive an email to inform you of the possible collection date. You will then have 7 days to collect your order from the Shop. If you are not available within this timeframe, please contact Customer Service at 03 21 43 33 04 from Monday to Friday from 9:00 to 18:30 and on Saturday from 9:00 to 12:30 and from 13:30 to 17:00. Don't forget to bring an ID! In case of unavailability, you also have the option to authorise a person of your choice to collect your parcel. Deliveries outside France:

For deliveries outside France, shipping costs depend on the destination and will be announced at the time of your order.

For transport reasons, some products cannot be shipped to certain countries as well as to Corsica: battery, tires, spray and lubricant, jacket and airbag vest.

If applicable, the information will be provided to you at the delivery stage of your order.

When it arrives in the destination territory, a customs clearance of 30 days may be carried out.

7.3 Taxes applied to your orders:

In the context of intra-community sales, VAT will be applied by default.

If the customer provides a valid intra-community VAT number after invoicing, Motoblouz reserves the right to refund the VAT initially charged, subject to verification of the validity of the intra-community VAT number and compliance with legal conditions.

Deliveries to DOM-TOM and outside the European Union:

For orders shipped to the Departments and Territories of Overseas (DOM-TOM) or outside the European Union:

  • Products are billed excluding taxes (HT).
  • Shipping costs are calculated based on the destination country and the weight of the parcel.

Upon receipt of the parcel, the buyer is required to pay customs duties, local VAT, and any other applicable taxes in their country. These fees are determined by local customs authorities and do not depend on the seller.

Particularities for DOM:

  • Local VAT applicable except in Guyana.
  • Port tax and regional port tax are applicable.
  • No customs duty is due for DOM.

Particularities for TOM:

  • Local VAT applicable only in French Polynesia.
  • Customs duties may apply depending on the territory.

Additional information:

  • Customs duties and taxes are calculated by customs authorities on the total amount of the order, including transport costs.

If you choose an express carrier, they may charge additional processing fees, corresponding to the management and payment of duties and taxes by delegation.

For shipments to Switzerland, parcels may transit through France (less than 2 kg) or Belgium (more than 2 kg), which may lead to variations in the customs fees applied.

Important: The buyer is responsible for any customs formalities in their country and for the payment of all applicable duties and taxes.

7.4 Anomaly with the delivery of your parcel

1- A missing or non-compliant product

At the relay point / locker or at home, check the general condition of your parcel before taking possession of it.

When your parcel is handed over, we advise you to check if it is damaged or opened. If so, it is recommended to issue a written reservation to the delivery person and inform us as soon as possible.

7.5 Anomaly with the delivery of your parcel

8. Right of withdrawal

In accordance with articles L.221-18 and following of the Consumer Code, you have a period of 14 calendar days from the receipt of your items to exercise your right of withdrawal without having to justify your decision or incur any additional costs.

In the case of an order for several items delivered separately, the period runs from the receipt of the last item.

To exercise your right of withdrawal, you must notify the company D3T DISTRIBUTION of your decision either through the duly completed withdrawal form, presented below in the General Terms and Conditions of Sale, or by any unambiguous correspondence expressing your wish to withdraw:

For any additional information on the modalities of exercising your right of withdrawal, you can contact us via the contact form available on the website www.motoblouz.fr or by calling us at 03.21.43.33.04.

In the event of exercising the right of withdrawal, we will refund the amounts paid, including the cost of delivery:

  • no later than 14 days from the date on which we are informed of your decision to withdraw, this date being deferred until the receipt of the returned item(s) or proof of their shipment, the date retained being that of the first of these events;
  • using the same payment method as that used at the time of the order, unless another method of reimbursement has been agreed upon between the parties.

In the case of total or partial payment of the order via the Illicado card, this card will be recredited for an amount identical to that paid in this form at the time of the order. If your return is from an order made in-store, the refund will be made in the form of a credit note and not on your Illicado card.

We inform you that if you have chosen a delivery method that is more expensive than the standard delivery method, the delivery costs will be refunded up to the cost of the standard delivery.

You are required to return or hand over the item(s) within 14 days following the communication of your decision to withdraw, noting that you have the option to return the item(s) directly to one of the MOTOBLOUZ stores during opening days and hours.

9. Return conditions

To withdraw, the Customer must:

  • print and complete the standard withdrawal form and send it to MOTOBLOUZ at the indicated address.
  • contact customer service: contact@motoblouz.com

In all cases, the withdrawal document must include at least the names and surnames of the Customer, as well as their order number and invoice.

9.1 When to return the item?

In accordance with the regulations in force, “the consumer returns or hands over the goods to the professional or to a person designated by the latter, without excessive delay and, at the latest, within fourteen days following the communication of their decision to withdraw in accordance with article L.221-23, unless the professional offers to collect these goods themselves.”

The product must be returned by the Customer, in its original condition and complete, necessarily accompanied by the purchase invoice, to the address indicated on the return slip at your expense. Return within 14 days at your expense for the items mentioned in point 9.3 of the GTC following the receipt of the parcel (return to be sent to Motoblouz: 72 Rue Elie Cartan 62220 Carvin).

It is also possible to return the item free of charge within 730 days (2 years) following the receipt of the parcel if your parcel has not been used with its original packaging and original label.

9.2 How to return the item?

Return the item in the box in which it was sent to you or in an identical box (reinforced, same size) if the first one has been damaged. Note that commercial packaging is not designed for transporting goods. To preserve the original box of the item, the return must be made by wrapping it in an outer box as during the initial shipment.

9.3 Conditions for your return to be accepted?

To ensure the acceptance of your return, the product must be:

  • New and perfectly intact, with no signs of use.
  • With its original packaging intact.
  • Accompanied by all accessories, labels, manuals, covers.
  • For helmets, reflective labels must not be stuck and the protective film on the screen must still be present.

No return will be accepted if the returned items have been visibly used or damaged by you and this use or damage renders these items unsellable. For new items with a defect upon receipt, the return request must be made within 30 days after receipt. Otherwise, a warranty claim will be made on the product upon its receipt in our premises. If a defect appears after use, a warranty procedure is possible under the product warranty (see warranty section).

Attention: The warranty service reserves the right to refuse the return if one of the conditions is not met, the parcel will then be returned to you directly.

Exceptions: For reasons of hygiene and safety, the customer cannot exercise their right of withdrawal for the following items: Underwear, socks, Warmcore, Caps and beanies, Tents, Unsealed maintenance products (aerosols, sprays, oils...).

Non-compliant return / Return of the wrong product: The customer must return the product purchased on the website www.motoblouz.com for which they exercised their right of withdrawal while respecting the acceptance conditions set out in the GTC (See GTC 9.3 Conditions for your return to be accepted).

If the customer returns a product that does not meet the acceptance criteria or does not return the correct product, Motoblouz will send them an email inviting them to contact us to arrange the return to the relay point, at Motoblouz's expense.

If the customer does not proceed with the receipt of this reshipment, the parcel will be automatically returned to us by our carrier. Upon receipt, we will then inform the customer that they will have a period of 2 (two) months from the date of the email to pay the reshipment costs.

If the customer wishes Motoblouz to proceed with a new shipment, the transport cost will then be charged to the customer prior to shipment.

After this two-month period, Motoblouz will consider itself the owner under article 2276, paragraph 1 of the Civil Code which states: "In terms of movable property, possession is worth title." and reserves the right to destroy the item. Motoblouz cannot be held responsible for this destruction.

9.4 How to make your return request?

Find in your order history the one concerning the item in question (it must date back less than 2 years). You can exchange your product for another, opt for a credit note or get a refund. The process will be explained to you step by step, but be sure to print the summary to attach to your parcel.

  • 9.4.1 If you reside in metropolitan France, Belgium or Luxembourg, also print the carrier slip (knowing that you will also receive it by email), the cost of which is covered by Motoblouz. The parcel drop-off will take place at the Mondial Relay point that suits you. Expect an average of 6 to 8 working days (from the date of parcel drop-off at the relay) for it to reach us and for us to process your request (replacement, credit note or refund).
  • 9.4.2 If you do not reside in metropolitan France, Belgium or Luxembourg, you can reship the parcel using the carrier of your choice (the shipment being at your expense). You will receive an email confirming the acceptance of your return. When returning your parcel by your own means, you must specify on the customs document that it is a return of merchandise; otherwise, customs duties and taxes will be charged to you upon receipt of the parcel in our premises. In the case of an exchange outside the European Union, customs services may require you to pay the duties and taxes again upon receipt of your exchange.
  • 9.4.3 You also have the option to return your products by going to The Shop Motoblouz, 72 rue Elie Cartan, 62220 Carvin and The Shop in Seclin. For this, go to your customer area to specify the desired return method, or go directly to The Shop so that our advisor can process the return. Please do not send your products to this address.
  • 9.4.4 You can also send us by mail this form or a declaration clearly expressing your wish to exercise your right of withdrawal.

9.5 Exceptions and Refund

The standard return period of 730 days from the receipt of the product may be subject to an exception in certain circumstances, particularly during specific commercial operations such as contests, special promotions or one-off offers, etc. The specific conditions applicable to these operations, including the specific return period, will be specified in the documents framing the concerned operation (for example: product sheet, contest rules, promotional poster for the operation...). Unless otherwise stated in these documents, the standard return period applies.

Refund terms:

In the event of exercising your right of withdrawal, MOTOBLOUZ undertakes to refund you within (14) fourteen days from the receipt of the item in its entirety.

The refund is made using the same payment method used by the Customer.

10. Warranties

MOTOBLOUZ is obliged, for all its products, to apply the legal warranty of conformity (articles L.217-3 to L.217-14 of the Consumer Code) and hidden defects (articles 1641 to 1649 of the Civil Code) under the conditions provided by law.

10.1 Legal warranty of conformity

When you act under the legal warranty of conformity:

  • you benefit from a period of two (2) years from the delivery of the item to act;
  • you can choose between repair or replacement of the item, subject to the cost conditions provided by article L. 217-9 of the Consumer Code;
  • you are exempt from proving the existence of the conformity defect of the item during the twenty-four (24) months following the delivery of the item (except for second-hand goods).

In any case, the legal warranty of conformity applies independently of any commercial warranty possibly granted by Motoblouz.com on the ordered product(s).

10.2 Legal warranty for hidden defects

Finally, the customer may decide to implement the warranty against hidden defects of the sold item within the meaning of article 1641 of the Civil Code. In this case, they can choose between the resolution of the sale or a reduction in the sale price in accordance with article 1644 of the Civil Code.

Annex Article D211-2:

The consumer has a period of two years from the delivery of the item to obtain the implementation of the legal warranty of conformity in case of appearance of a conformity defect. During this period, the consumer is only required to establish the existence of the conformity defect and not the date of its appearance.

When the sales contract of the item provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal warranty applies to this digital content or digital service throughout the planned supply period. During this period, the consumer is only required to establish the existence of the conformity defect affecting the digital content or digital service and not the date of its appearance.

The legal warranty of conformity entails an obligation for the professional, where applicable, to provide all necessary updates to maintain the conformity of the item.

The legal warranty of conformity gives the consumer the right to repair or replace the item within thirty days following their request, at no cost and without major inconvenience to them.

If the item is repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.

If the consumer requests the repair of the item, but the seller imposes the replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the item.

The consumer can obtain a reduction in the purchase price by keeping the item or terminate the contract by obtaining a full refund against the return of the item, if:

  • 1° The professional refuses to repair or replace the item;
  • 2° The repair or replacement of the item occurs after a period of thirty days;
  • 3° The repair or replacement of the item causes a major inconvenience for the consumer, particularly when the consumer permanently bears the costs of taking back or removing the non-compliant item, or if they bear the costs of installing the repaired or replaced item;
  • 4° The non-conformity of the item persists despite the seller's unsuccessful attempt to bring it into conformity.
  • The consumer is also entitled to a reduction in the price of the item or to the resolution of the contract when the conformity defect is so serious that it justifies an immediate reduction in price or resolution of the contract. The consumer is then not required to request the repair or replacement of the item in advance.

    The consumer does not have the right to terminate the sale if the conformity defect is minor.

    Any period of immobilization of the item for repair or replacement suspends the warranty that remained to run until the delivery of the restored item.

    The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the Consumer Code.

    The seller who in bad faith obstructs the implementation of the legal warranty of conformity incurs a civil fine of up to 300,000 euros, which may be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).

    The consumer also benefits from the legal warranty against hidden defects under Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the item is kept or a full refund upon return of the item.

    10.3 Commercial warranty

    The products sold are covered by a commercial warranty aimed at ensuring their conformity and providing for the refund of the purchase price, replacement, or repair of the goods. It does not cover defects caused by abnormal or improper use or resulting from a cause external to the intrinsic qualities of the products or the defects mentioned on the product sheet for "second choice/refurbished" products. Information regarding any commercial warranties related to the products and services offered for sale (including the content of the warranty, the terms of its implementation, its price, duration, territorial scope, as well as the name and address of the guarantor depending on the products, services, and brands concerned) is made available to the customer, where applicable, on the product and service sheet in the online sales space.

    11. Data Protection Act

    The personal data collected in the context of the contractual relationship is processed by D3T DISTRIBUTION, as the data controller, in accordance with our Privacy Policy. This Policy, complementary to these general terms and conditions of sale, is accessible on the website at the following address: https://www.motoblouz.com/en/privacy-policy.html, and indicates how we use your personal data..

    12. Sponsorship

    To be eligible to sponsor their relatives, the godmother or godfather must have a Motoblouz account. The sponsored individuals must not be subject to an ongoing sponsorship request. They must not have an account on Motoblouz.com. The godmother or godfather will receive a voucher of €20 for a minimum purchase of €100 if the sponsored individual has paid for €100 or more in purchases, and when their order has been invoiced. The vouchers are personal, reserved for godmothers or godfathers, valid for 3 months after receiving the email confirming the validation of the sponsorship. The vouchers are not transferable, cannot be used partially, cannot be combined with other vouchers and credits, and will not result in any monetary compensation in any form, nor do they exclude participation in the order processing fees. The €20 vouchers are refundable only in vouchers. They can be used on the entire site except for the purchase of gift cards. The welcome offer for sponsored individuals consists of a €10 discount on their first order, for a minimum purchase of €100. To qualify, they must order within 2 months following your sponsorship. The email addresses collected during the sponsorship offer will not be subject to commercial follow-up and will only be used strictly within the framework of the sponsorship programme.

    13. Liability

    The products marketed by Motoblouz must be used in accordance with their intended purpose, the user manuals, and applicable standards. Motoblouz's liability cannot be engaged in the event of non-compliant use, modification of the product, normal wear and tear, negligence, or lack of maintenance of the product by the Customer.

    14. Force majeure

    Events defined as force majeure are those as defined in Article 1218 of the Civil Code and by the jurisprudence of French courts and tribunals. Any case of force majeure suspends the obligations of these general terms and conditions of sale affected by it for its entire duration and as long as the effects of the force majeure are felt, without Motoblouz's liability being engaged or being held to any compensation.

    15. Entirety

    These general terms and conditions constitute the contract governing the relationship between the Customer and MOTOBLOUZ.

    They constitute the entirety of the rights and obligations framing these relationships.

    If one or more provisions of these general terms and conditions were declared null under a law, regulation, or as a result of a final decision of a court, the other provisions will retain their full force and scope.

    Furthermore, the fact that one of the parties does not invoke a breach by the other party of any of the provisions of these general terms and conditions cannot be interpreted as a waiver on its part to invoke it later.
