Terms and of Use

These terms of use (“the ToU”) are intended the terms and conditions under which Motoblouz makes its website motoblouz.com (the “Site”) as well as any web address, domain, or subdomain that may subsequently replace it in the future (together referred to as “the Platform”),available to internet users who access it (“the User”). Acceptance of the ToU is materialized by any consultation, display, use or transmission of the Platform and, where applicable, , by the User’s express acceptance of the ToU by the User when creating a member account.

For legitimate reasons such as the evolution of services, technical constraints, security or legal compliance, Motoblouz may modify the ToU. Users will be informed of any substantial modification prior to the new version of the ToU taking effect. If the User refuses the substantial modifications to the T&Cs, they must refrain from using the Platform and its features and services.

The French version of the ToU prevails over any other version or translation.

Article 2 – Features of the Platform

The Platform enable Users to:

  • Discover the products offered by Motoblouz (the “Products”);
  • Create a customer account and access it (the “Account”);
  • Contact Motoblouz customer service via email, chat or phone or make an appointment ;
  • Purchase the products offered by Motoblouz online;
  • Access the online messaging system.

This list of features is provided for informational purposes only. Motoblouz reserves the right to add or remove them, temporarily or permanently, without the User's consent.

Article 3 - Access terms to the Platform

3.1. Conditions for accessing the Platform

Access to the Platform is permitted for any adult individual, who is of legal age or at least 15 years old and who has full legal capacity. Users under the age of 15 must have the prior and explicit consent of a parent or person with parental authority to access or use the Platform.

Access to the Platform requires an internet connection. It is optimized for the latest versions of Android and iOS. TUsers are responsible for providing the necessary equipment (smartphones, tablets, etc.), and for any communication costs incurred through their use.

3.2. Account creation

Access to certain features of the Platform requires the creation of an Account. When creating an Account, Users must provide their first name, last name, email address, and phone number. The Users agrees to provide accurate and complete data about their identity and to keep it up to date. They are also prohibited from impersonating a third party.

When creating the Account, the User must define a password. This must be sufficiently secure (including uppercase and lowercase letters, numbers, and special characters) and must be renewed regularly by the User. It is the User's responsibility to keep their password confidential.

Log in via a third-party authentication service

Users can create or log into their Motoblouz Account using third-party authentication services such as Facebook and Google (“Identity Providers”). Using this feature means that the User authorizes the chosen identity provider to transmit the personal data necessary for creating or logging in to their account on the Platform. Depending on the identity provider and the permissions granted by the user, this data may include: name, first name, email address, unique identifier and profile picture. This information is used exclusively for authentication and account management on Motoblouz. No additional data (such as contacts, posts, preferences, friend lists, activity history, or behavioural data) is collected by us without the user's explicit consent.

Users can unlink their third-party account at any time; they will then need to reset their password to continue using their Motoblouz Account. Motoblouz may ask Users to create a new password at a later date, for example if they unlink their third-party Account or if there are security requirements.

The User is solely responsible for the use of their Account. If their account is used by a third party without authorisation or if there is a breach of confidentiality and security of their identification means, the User must inform Motoblouz without delay. Each User agrees to create only one account corresponding to their profile.

Motoblouz may temporarily or permanently close a customer Account, without notice or compensation in the event of a violation of French regulations, these ToU, or the General Terms of Sale.

Users may close their account at any time by emailing : contact@motoblouz.com. Once a User's account has been closed, all transmitted and generated data will be destroyed by Motoblouz in accordance with legal and contractual provisions.

Article 4 – Intellectual Property

Motoblouz owns the intellectual property rights relating to all content and elements of the Platform. In this respect:

  • All graphic elements, images, photographs, videos, texts and sound or non-sound animated sequences presented on the Platform, presented on the Platform, as well as the title, design and form of the Platform, the content including comments and customer reviews, editorials and their organization, and any compilation of software, fundamental source code and software (including applets) constituting and/or represented on the Platform are, as applicable, the property of Motoblouz or third parties who have authorized Motoblouz to represent them on the Platform.
  • The name, trademarks, logos and slogans, graphic charters, product and service names, domain names, downloadable documents and photographic representations, and all related distinctive signs are, unless otherwise indicated, the property of Motoblouz or third parties who have authorized Motoblouz to represent them on the Platform.
  • Any reproduction, disclosure, distribution, broadcasting, use, representation, modification, transcription, adaptation, translation, and/or transformation, whether partial or total, by any means and by any process, is strictly prohibited, unless prior and express authorization from the publication manager has been obtained.
  • No integral or substantial extraction, reproduction and/or representation, whether partial or total, may be made without the prior written consent of Motoblouz.
  • Any transfer of any element of the Platform to another site or any other medium (paper, digital medium, film, etc.) is prohibited, unless prior and express authorization from the publication manager has been obtained.

Motoblouz grants internet users viewing authorization of the Platform’s content for personal and private use only, as well as a authorization to reproduce it in digital form on their computer for the purpose of viewing the pages. Any violation of the provisions of this article constitutes an infringement, for which the author is liable both civilly and criminally.

Article 5 – User Obligations

The User agrees to use the Platform fairly and, in accordance with its intended purpose as set out in the ToU, as well as in compliance with applicable laws and regulations. In this regard, Users must refrain from:

  • Transmitting, publishing, distributing, recording or destroying any material, particularly the Platform's content, in violation of applicable laws or regulations in force regarding the collection, processing or transfer of personal data;
  • Creating fictitious profiles or providing inaccurate information in the form or failing to update it regularly;
  • Disseminating (e.g., chatbots, questions asked by Users) data, information, or content of a defamatory or injurious nature on the plateform;
  • Obtaining passwords or personal identification details from other Users;
  • Using information, content or any data from the Platform to offer a service deemed competitive to the Platform by Motoblouz at its sole discretion;
  • Selling, exchanging or monetizing information, content or any data present on the Platform or services offered on the Platform, without the express and written consent of Motoblouz;
  • Offering and promoting their own services (such as coaching, sports courses, selling equipment, etc.);
  • Using software or manual or automated devices, coding robots, or other means to access, explore, extract or index any page of the Platform;
  • Endangering or attempting to endanger the security of the Platform. This includes attempting to control, scan or test the vulnerability of a system or network or to violate security or authentication measures without prior express authorization;
  • Imitating the appearance or operation of Motoblouz's sites or applications, for example by creating a mirror effect;
  • Disrupting or disturbing, directly or indirectly, the Platform, or or imposing an undue burden on the Platform's infrastructure or attempting to transmit or activate computer viruses via or on the Platform.

Article 6 – Personal Data

Motoblouz places great importance on protecting of the privacy of its Users and their personal data. The personal data protection policy aims to inform Users about Motoblouz's practices relating to consent, the collection, use, storage, and security of personal data, retention periods and the recipients, and sharing of personal data that user are required to provide when using the Motoblouz Platform. Article 7 – Liability

7.1. Use of the Platform

Motoblouz's role is limited to providing the technical infrastructure of the Platform to users. Users are solely responsible for the consequences of using the Platform which is provided “as is.” Motoblouz does not guarantee that the use of the Platform complies with the User’s requirements, whether they are making or planning to make use of it. Motoblouz shall not be held responsible for any fraudulent or malicious use of the Platform. Motoblouz may restrict, suspend or delete any user’s Account without notice or refund if they use the Platform abusively or inappropriately. Motoblouz reserves the right to assess User behaviour at its sole discretion.

7.2 Availability of the Platform

Motoblouz takes all reasonable steps to ensure the Platform is available and functioning properly at all times, except during maintenance operations, updates, and in cases of force majeure. Motoblouz reserves the right to interrupt, suspend , or limit access to all or part of the Platform temporarily for maintenance or for any other technical reason necessary for its proper functioning. This interruption will not give rise to any compensation. Despite taking all necessary steps to ensure the reliability of the information, services, software or products contained on the Platform, Motoblouz cannot be held responsible for any errors, omissions, or viruses or for any results obtained from their misuse. Motoblouz shall not be held responsible for any temporary difficulties or impossibilities in accessing the Platform arising from external circumstances, particularly in the event of telecommunications network failure, Internet failure or failure of the User's computer equipment or in the event of user misuse.

7.3 Security of the Platform

Motoblouz ensures the security of the Platform in accordance with industry standards. However, the user is informed of the inherent risks of electronic communication networks, particularly those associated with transmitting data over the internet. In general, it is the User's responsibility to ensure they have all the usual protections (firewalls, antivirus software, etc.) for internet browsing. Consequently, Motoblouz offers no guarantee in this regard. Under no circumstances may, the User attempt to reverse engineer or decompile all or part of the Platform; intrude into or attempt to intrude into the information system hosting the Platform or the software enabling its operation; or breach trust, steal, delete, divert, or modify the technical data of the Platform, under penalty of prosecution. In the context of connection via a third-party authentication service, Motoblouz implements standard market protocols. Motoblouz never stores third-party account passwords and only retains the necessary tokens/technical identifiers necessary for authentication and session security.
Please note that violations of system or network security may lead to civil and criminal prosecution. Motoblouz monitors for such violations and may call upon the relevant authorities to prosecute, Users who have participated in them.

7.4. General Provisions

Motoblouz reserves the right to suspend or close the User's Account or their access to the Services, in the event of a violation of the applicable regulations, these ToU or the General Terms of Sale, without prejudice to any legal action that may be taken.
In any case, Motoblouz shall not be liable under any circumstances for the losses or indirect damages suffered by Users or third parties. This includes in particular any lost profits, inaccuracies or corruption of files or data, or loss of opportunity relating to these ToU in any way.
Motoblouz shall not be responsible:
- For any delay or non-performance of this Contract that is justified by a case of force majeure, as defined by French court and tribunal case law;
- For fraudulent or malicious use of the Platform by the User or for non-compliance with these ToU.

Article 8 – Proof Agreement

In dealings between Motoblouz and the User, the computer systems and files shall be deemed authentic. Motoblouz may therefore validly produce, in the context of any procedure, for proof purposes, any data, files, programs, recordings or other elements, received, issued, or stored using Motoblouz’s computer systems or any digital or analogue media and may rely on them unless there is a manifest error.

Article 9 – Dispute Resolution

These Terms of Use (ToU) are governed by French law. Any dispute relating to the conclusion, validity, performance, or interpretation of the stipulations of the ToU provisions must first be resolved through negotiation between Motoblouz and the User.
If the dispute remains unresolved, the user may refer the matter the to the consumer mediator to which Motoblouz subscribes free of charge:

Any dispute arising from the failure to reach an amicable agreement shall fall under the exclusive jurisdiction of the competent French courts.
