GENERAL TERMS AND CONDITIONS OF USE FOR THE MY MOTOBLOUZ LOYALTY PROGRAM
The Motoblouz loyalty program (hereinafter referred to as "My Motoblouz") is developed and managed by MOTOBLOUZ, a simplified joint stock company with capital of €9,195.00, registered with the Arras Trade and Companies Register under number 478 566 250, having its registered office at 72 rue Elie Cartan, zone artisanale de la Gare d'Eau 62220 CARVIN, represented by Mr Jérôme Dalidet.
The present general terms and conditions (hereinafter the "GCU") define the conditions of participation in the My Motoblouz loyalty program, based on the actions and events that enable points to be accumulated and give entitlement to benefits under the conditions described below.
These GCU are accessible on the motoblouz.com website and in the Stores eligible for the program as defined below. Registration with My Motoblouz implies unreserved acceptance of these GCU.
Definitions
"Membership": valid without an end date, starting as soon as you register for the My Motoblouz program. The membership date corresponds to the registration date.
"Eligible Stores": MOTOBLOUZ stores excluding the Tours store.
"Loyalty Program Member" or "Member" : any person benefiting from the advantages of My Motoblouz, after having fulfilled the Membership conditions set out herein and available on motoblouz.com.
"Eligible Products" : Products for which points can be earned, i.e. : - all products sold on the motoblouz.com website or in Eligible Stores. - excluding e-cards, gift cards, the bar, shipping costs, 20-year t-shirts, in-store services, used vehicles and rentals.
"Site" : refers to the MOTOBLOUZ website, accessible at https://www.motoblouz.com/.
2.1 Eligibility
To join My Motoblouz, the customer must be an adult and have a customer account. The Loyalty Program is offered in Eligible Shops and on the Site.
When use of the Fidélité Program requires an Internet connection and computer equipment, all costs, fees, subscriptions, taxes and other related expenses remain the responsibility of the Member.
By subscribing to the Fidélité Program, the customer acknowledges that he/she has read the present terms and conditions beforehand and has accepted them unreservedly.
MOTOBLOUZ reserves the right to modify the conditions of Membership at any time and will inform the Member by any means.
2.2 Registration procedure
Membership of My Motoblouz requires the creation of a customer account, if the customer does not already have one.
The customer account allows the member to consult his loyalty points balance, to transform his points into vouchers, to carry out actions to earn points and to update his contact details.
Registration for the My Motoblouz Loyalty Program is free of charge, with the exception of the Internet connection costs required to use the site, and can be carried out online on our website, in stores or by contacting customer service on 03.21.43.33.04.
When registering, the user must provide accurate and complete information. In the event of incorrect or incomplete information, the customer account cannot be created. The following information is required on the site and in stores: title, surname, first name, valid e-mail address, cell phone number, postcode/city and password. The password must comply with the security requirements provided by Motoblouz.
This membership is strictly personal and cannot be used by another person. The user may create an account only once, but may join and cancel his My Motoblouz membership several times.
In the event of doubt as to compliance with these General Terms and Conditions, MOTOBLOUZ reserves the right to request proof of identity from the member and not to award points or other benefits linked to My Motoblouz once the verification carried out has demonstrated a breach of these General Terms and Conditions.
2.3 Registration validation
Registration will be validated upon receipt of a confirmation e-mail to the address provided by the user. Motoblouz cannot be held responsible for the non-receipt of the confirmation email in the event of inaccurate information.
In order to benefit from the advantages of the My Motoblouz loyalty program, members simply need to identify themselves either by logging into their customer account on the site or by entering their email address in eligible stores.
3.1 Cashback / accumulation of points
3.1.1 Cashback terms and conditions
Loyalty points are awarded on the basis of purchases made on eligible products or specific actions detailed in the "How to earn points" section in the My Motoblouz area of the customer account.
For all first-time My Motoblouz members, a bonus of 200 points is earned for use on the first purchase after joining. A member who has left the My Motoblouz loyalty program and re-registers will not be able to benefit from the 200-point bonus again.
Each euro spent can correspond to a certain number of points, depending on the conditions in force at the time of purchase, or specific actions.
The applicable scale for accumulating points on the purchase of eligible products is as follows: €1 = 1 point.
The way in which points are awarded following a purchase may vary according to promotions or special offers.
Members can also earn more points through permanent actions and by completing their "My garage" space.
Earnings from permanent actions are as follows: - An answer to a question asked by another customer, submitted and approved: 20 points - A review submitted and approved: 50 points - A review submitted and approved, including at least 2 photos: 75 points - A review submitted and approved for the DXR, Dexter, Prov and Kooroom brands: 100 points - Top 5 approved reviews for a new product : 150 points
The My Garage area will be accessible to all member customers once they have joined the My Motoblouz loyalty program, and once their first order has been validated and paid for.
In this area, which is only available in the customer account on the site, customers can carry out actions that earn them points.
These actions can only be carried out once by the customer: - Follow Motoblouz on the Facebook social network: 10 points - Follow Motoblouz on Instagram: 10 points - Subscribe to the Motoblouz newsletter: 20 points - Subscribe to Motoblouz SMS communications: 20 points - Register your motorcycle in the My Motorcycle area of the site: 50 points
The following actions must be approved by BazaarVoice moderation: - Answer 5 questions asked by other bikers about products on the site: 150 points - Submit 5 product reviews on products purchased: 400 points
Each action carried out in the My Garage space results in the visual evolving.
Members of the My Motoblouz loyalty program may also accumulate points (known as "bonus points") on the basis of conditions that will be communicated to them from time to time by MOTOBLOUZ (e.g.: top-up or doubling of points during special sales operations, etc.).
Members of the My Motoblouz loyalty program will also have the opportunity to make a request to customer service in order to merge their account if they have another customer account with the same information (surname, first name, address, telephone). Merging two accounts means that all accumulated points can be merged into a single account, but that all exceptional benefits (such as free points, points for anniversaries, specific actions, etc.) will be deleted.
3.2 Points / Kitty lifetime
All points accumulated through purchases of eligible products will be credited and available within 30 days of order billing for use under the conditions set out in this article within 13 months of the purchase billing date.
If the member returns all or part of his/her order 30 days after the invoice date, the amount of points earned on the returned product(s) will be deducted from the member's account.
All points offered by MOTOBLOUZ will be credited within 30 days, and can be used immediately within 3 months of the date on which the points were credited.
The member has three counters visible in his customer account.
- POINTS IN THE PROCESS OF BEING ACQUIRED
When an order is dispatched, the points earned on that order will appear in the "Points in progress" counter. Points will remain in this counter for 30 days. Once the 30 days have elapsed, the member's points will automatically be transferred to the "Points earned" counter and can be used by the member.
- EARNED POINTS
This counter contains points acquired 30 days after an order has been shipped or points offered by Motoblouz (Anniversary, membership, etc.). Points acquired following a purchase are valid for 13 months after the order has been dispatched.
- EXPIRING POINTS
This counter shows points with an expiry date in the current month. If the member converts their points into vouchers, the points in this counter will be converted first.
The accumulation of loyalty points is effective for purchases made after joining My Motoblouz. MOTOBLOUZ is under no obligation to allocate to the accumulation of loyalty points purchases made by the member prior to registration with My Motoblouz.
3.3 Use of points
Members may convert their points into rewards from a range of rewards offered by MOTOBLOUZ. This conversion can take place in the customer account, My Motoblouz tab, "Rewards catalog" section, or in eligible stores.
From 200 points : members can convert their points into a My Motoblouz loyalty voucher worth €5, valid for 3 months from the date it was generated.
From 400 points : the member has the possibility of transforming his/her points into a My Motoblouz loyalty voucher worth €15, valid for 3 months from the date it was generated.
From 600 points : the member can transform his points into a My Motoblouz loyalty voucher worth €25, valid for 3 months from the date it was generated.
From 800 points : the member has the possibility of transforming his points into a My Motoblouz loyalty voucher worth 35€ valid for 3 months, from the date it was generated.
From 1000 points : the member has the possibility to transform his points into a My Motoblouz loyalty voucher worth 45€ valid for 3 months, from the date it was generated.
Vouchers can be accessed directly from the customer account: ? Either in the My Motoblouz tab, "My unlocked rewards" section ? Or in the Purchase vouchers and gift cards tab.
Points cannot be exchanged for cash, and rewards cannot be transferred or resold. Points can only be used with My Motoblouz.
3.4 Member benefits
Birthday
For all members who have entered their date of birth in their customer account, MOTOBLOUZ will offer 200 points 7 days before the date entered, available immediately and usable within 3 months from the date the points are credited. This offer is valid for 365-day periods.
Membership
The first time you join My Motoblouz, 200 points are available and can be used within 3 months of the date the points are credited.
Other benefits
MOTOBLOUZ reserves the right to supplement the advantages included in My Motoblouz, in particular through services offered by internal and/or external partners. These advantages are subject to the specific conditions of My Motoblouz, as well as to the conditions of Motoblouz's partners.
My Motoblouz membership has no end date. A member may leave the loyalty program at any time My Motoblouz on his customer account or in eligible stores.
The nature and extent of the benefits and privileges to which My Motoblouz entitles the Member, as well as the terms and conditions of use and validity, may be modified by MOTOBLOUZ, without prior notice, and without any claim or compensation being able to be demanded by the Member.
MOTOBLOUZ therefore reserves the right to modify and/or adapt and/or delete My Motoblouz, in whole or in part, without prior notice. In this case, members will be informed as soon as possible by any means. No modification shall entitle members to compensation. In the event of termination of My Motoblouz, members who have collected points will be able to use them under the conditions then in force for a period not exceeding 3 months from the termination of My Motoblouz.
MOTOBLOUZ therefore reserves the right to modify and/or adapt and/or delete My Motoblouz, in whole or in part, without prior notice. In this case, members will be informed as soon as possible by any means. No modification shall entitle members to compensation. In the event of termination of My Motoblouz, members who have collected points will be able to use them under the conditions then in force, for a period not exceeding 3 months from the termination of My Motoblouz.
Any breach of these GCU, any abusive or fraudulent use of the advantages offered by My Motoblouz, any behaviour prejudicial to the interests of MOTOBLOUZ, any falsification of information transmitted by a member or by a third party acting on behalf of a member, will automatically result in the removal of the said member, the cancellation of any points or advantages obtained, without compensation of any kind.
MOTOBLOUZ also reserves the right to demand that any member guilty of fraud reimburse any sums unduly received, and/or to institute legal proceedings, including criminal proceedings.
MOTOBLOUZ is exempt from all liability for any consequences, direct or indirect, of any malfunctioning of My Motoblouz. In the event of a malfunction, MOTOBLOUZ will nevertheless do its utmost to ensure that the member retains the benefit of his accumulated purchase days and points.
In the event of a dispute concerning the amount accumulated, only the information contained in MOTOBLOUZ's database will be deemed authentic.
