GENERAL TERMS AND CONDITIONS OF USE (GTCU) FOR THE MY MOTOBLOUZ LOYALTY PROGRAM

The Motoblouz loyalty program (hereinafter referred to as “My Motoblouz”) is developed and managed by MOTOBLOUZ, a simplified joint-stock company with a capital of €9,195.00, registered with the Arras Trade and Companies Register under number 478 566 250, with its registered office at 72 rue Elie Cartan, artisan zone of the Gare d’Eau 62220 CARVIN, represented by Mr. Jérôme Dalidet.

These general terms and conditions (hereinafter referred to as the “GTCU”) define the conditions for participating in the My Motoblouz loyalty program, based on the actions and events that allow points to be accumulated and entitle members to benefits under the conditions described below.

These GTCU are accessible on the motoblouz.com website as well as in the Eligible Stores for the program as defined below. Registration for My Motoblouz implies acceptance of these GTCU without reservation.

Definitions

“Membership”: valid indefinitely, starting from the registration date for the My Motoblouz program. The membership date corresponds to the date of registration.

“Eligible Stores”: stores of the MOTOBLOUZ brand excluding the Tours store.

“Loyalty Program Member” or “Member” : any person benefiting from the advantages of My Motoblouz, after fulfilling the Membership conditions set forth herein and available on motoblouz.com

“Eligible Products” : Products that can give rise to point accumulation, namely:
- all products sold on the motoblouz.com website or in Eligible Stores.
- excluding e-gift cards and gift cards, bar items, shipping costs, 20th anniversary t-shirts, in-store services, used vehicles, rentals, products in the “Tires” category.

“Site” : refers to the MOTOBLOUZ website, accessible from the address https://www.motoblouz.com/

2.1 Eligibility

To join My Motoblouz, the customer must be a legal adult and have a customer account. The Loyalty Program is offered in Eligible Stores and on the Site.

When using the Loyalty Program requires an internet connection and computer equipment, all costs, fees, subscriptions, taxes, and other expenses related to it remain the responsibility of the Member.

By joining the Loyalty Program, the customer acknowledges that they have previously read these GTCU and accepted them without reservation.

MOTOBLOUZ reserves the right to modify the Membership conditions at any time and will inform the Member by any means.

2.2 Registration Procedure

Any membership in My Motoblouz requires the creation of a customer account if the customer does not already have one.

The customer account allows the member to check their loyalty points balance, convert points into vouchers, perform actions to earn points, and update their contact details.

Registration for the My Motoblouz loyalty program is free, except for the internet connection costs necessary for using the site and can be done online on our website, in stores, or by contacting customer service at 03.21.43.33.04.

When registering, the user must provide accurate and complete information; in case of missing and/or incorrect or incomplete information, the customer account cannot be created. The following information will be required on the site and in stores: title, last name, first name, valid email address, mobile phone number, postal code/town, and password. The password must meet the security requirements communicated by Motoblouz.

This membership is strictly personal and cannot benefit another person. The user can create their account only once but can join and cancel their membership in My Motoblouz multiple times.

In case of doubt regarding compliance with these General Conditions, MOTOBLOUZ reserves the right to request proof of identity from the member and to withhold points or other benefits related to My Motoblouz if the verification shows a breach of these General Conditions.

2.3 Registration Validation

Registration will be validated upon receipt of a confirmation email at the address provided by the user. If the contact details provided by the user are incorrect, Motoblouz cannot be held responsible for the non-receipt of the confirmation email.

To benefit from the advantages of the My Motoblouz loyalty program, the member simply needs to identify themselves either by logging into their customer account on the site or by providing their email in eligible stores.

3.1. Accumulation of Points

3.1.1 Accumulation Terms

Loyalty points are awarded based on purchases made on eligible products or specific actions detailed in the section "How to earn points?" in the My Motoblouz space of the customer account.

For any first membership in the My Motoblouz loyalty program, a bonus of 50 points is automatically credited to the member's account. A member who has left the My Motoblouz loyalty program and re-registers will not be able to benefit again from the 50-point bonus.

Each euro spent may correspond to a certain number of points, depending on the conditions in effect at the time of purchase, or specific actions.

The applicable scale for accumulating points on the purchase of eligible products is as follows: 1 € = 1 point

The way points are awarded following a purchase may vary depending on promotions or special offers.

Members may also earn additional points through ongoing actions and by completing their “My Garage” space.

The gains from ongoing actions are as follows:
- A response to a question asked by another customer regarding a product you have purchased, submitted and approved: 20 points
- An approved review: 50 points
- An approved review including at least 2 photos: 75 points
- An approved review on the brands DXR, Dexter, Prov, and Kooroom: 100 points
- Being among the first 5 approved reviews on a new product: 100 points

Each review or response must contain at least 50 characters.

The My Garage space will be accessible to any member customer after their membership in the My Motoblouz loyalty program, and once a first order has been validated and paid for.

In this space, available only in the customer account on the site, the customer can perform actions that will earn them points.

These actions can only be performed once by the customer:
- Follow Motoblouz on the Facebook social network: 10 points
- Follow Motoblouz on the Instagram social network: 10 points
- Subscribe to the Motoblouz newsletter: 20 points
- Subscribe to Motoblouz SMS communications: 20 points
- Enter their motorcycle in the My Motorcycle space on the site: 50 points

The following actions must be approved by BazaarVoice moderation:
- Answering 5 questions asked by other bikers on product sheets on the site regarding products you have purchased: 150 points
- Submitting 5 product reviews on purchased products: 400 points

Each action in the My Garage space performed leads to a change in the visual.

Members of the My Motoblouz loyalty program can also accumulate points (called “bonus points”), based on conditions that will be communicated to them from time to time by MOTOBLOUZ (e.g., bonus or doubling of points during specific promotional events, etc.).

Members of the My Motoblouz loyalty program will also have the opportunity to request customer service to merge their account if they have another customer account with the same information (Name, surname, address, phone). Merging two accounts means that all accumulated points can merge into one account, but all exceptional benefits (such as bonus points, birthday points, specific actions...) will be removed.

3.2 Lifespan of Points / Accumulations

All points accumulated through purchases of eligible products will be credited and available within 30 days after invoicing of the order for use under the conditions set out in this article within a period of 13 months after the date of invoicing of the purchase.

If the member returns all or part of their order 30 days after the invoicing date, the amount of points earned from the returned product(s) will be deducted from the member's accumulation.

All points offered by MOTOBLOUZ will be credited within 30 days and can be used immediately within 3 months from the date of point credit.

The member has three visible counters in their customer account.

- POINTS IN THE PROCESS OF ACQUISITION

When an order is shipped, the points earned from this order will be present in the “Points in the process of acquisition” counter.
Points will remain in this counter for 30 days. Once the 30 days have passed, the member's points will automatically transfer to the “Acquired Points” counter and can be used by the member.

- ACQUIRED POINTS

This counter contains the points acquired 30 days after the shipment of an order or the points offered by Motoblouz (Birthday, membership, …).
Points acquired from a purchase are valid for 13 months after the order is shipped.

- POINTS IN THE PROCESS OF EXPIRATION

This counter contains points with an expiration date in the current month.
If the member converts their points into vouchers, the points in this counter will be converted first.

The accumulation of loyalty points is effective for purchases made after joining My Motoblouz. MOTOBLOUZ is in no way obliged to allocate to the accumulation of loyalty points purchases made by the member before their registration in My Motoblouz.

3.3 Use of Points

The member has the option to convert their points into rewards from a range of rewards offered by MOTOBLOUZ.
This conversion can take place in the customer account, in the My Motoblouz tab, section “Rewards Catalogue” or in eligible stores.

The member has the option to convert their points into My Motoblouz loyalty vouchers according to the following scale:

200 points: voucher worth 5 € (EUR) • 20 PLN • 55 SEK
400 points: voucher worth 15 € (EUR) • 60 PLN • 165 SEK
600 points: voucher worth 25 € (EUR) • 100 PLN • 275 SEK
800 points: voucher worth 35 € (EUR) • 150 PLN • 385 SEK
1000 points: voucher worth 45 € (EUR) • 200 PLN • 495 SEK

Vouchers are valid for 3 months from the date they were generated.

Vouchers will be directly accessible from the customer account:
- Either in the My Motoblouz tab, section “My unlocked rewards”
- Or in the Vouchers and gift cards tab.

Points cannot be exchanged for cash, and rewards cannot be transferred or resold. Points can only be used with My Motoblouz.

Vouchers cannot be used for the purchase of gift cards or products in the “Tires” category. Vouchers are neither divisible, nor exchangeable, nor refundable.

3.4 Benefits for Members

Birthday

For all members who have provided their date of birth in their customer account, MOTOBLOUZ will offer 50 points 7 days before the provided date, available immediately and usable within 3 months from the date of point credit. This offer is valid for a period of 365 days.

Membership

Upon first membership in My Motoblouz, 100 points are available and usable within 3 months from the date of point credit.

Other Benefits

MOTOBLOUZ reserves the right to supplement the benefits included in My Motoblouz, particularly through services offered by internal and/or external partners. These benefits are subject to the specific conditions of My Motoblouz, as well as the conditions of Motoblouz partners.

Membership in My Motoblouz has no end date. A member has the option to leave the My Motoblouz loyalty program at any time from their customer account or in eligible stores.

Thus, MOTOBLOUZ reserves the right to modify and/or adapt and/or terminate My Motoblouz, in whole or in part, without notice. In this case, members will be informed as soon as possible by any means. No modification will give rise to compensation for them. In the event of termination of My Motoblouz, members who have collected points will be able to use them under the conditions then in force for a period not exceeding 3 months from the termination of My Motoblouz.

Any breach of these GTCU, any abusive or fraudulent use of the benefits offered by My Motoblouz, any behavior detrimental to the interests of MOTOBLOUZ, any falsification of information transmitted by a member or by a third party acting on behalf of a member, will automatically result in the termination of said member, the cancellation of points or benefits they may have obtained, without compensation of any kind.

MOTOBLOUZ also reserves the right to demand the return of any sum unduly received by a member guilty of fraud, and/or to initiate legal proceedings, including criminal proceedings.

MOTOBLOUZ is exempt from any liability for all consequences, direct or indirect, of any malfunctions of My Motoblouz. In case of malfunction, MOTOBLOUZ will nevertheless make its best efforts to ensure that the member can retain the benefit of their accumulated purchase days and points.

In case of dispute regarding the accumulated amount, only the information contained in the MOTOBLOUZ database will be deemed valid.
